This action was brought to recover damages occasioned by the alleged negligence of defendant, John Snow, in the operation of his motor vehicle. A jury verdict was returned in favor of defendant, along with a special interrogatory finding plaintiff, Mary Angelini, guilty of contributory negligence. Plaintiff moved for a judgment n.o.v. or, in the alternative, for a new trial on the grounds that the application of the doctrine of contributory negligence deprived her of certain constitutional rights.
