for the Court:

¶ 1. This is an appeal from the Circuit Court of Madison County which affirmed the decision of the County Court of Madison County to grant a peremptory instruction in favor of Roger Penn, the appellee and defendant below. The appellant, Dwan Harris, asserts that Penn’s motion for a peremptory instruction should not have been granted by the county court and that the circuit court committed reversible error in affirming the decision.
