The plaintiffs claimed as heirs at law of Israel Ludlow, and upon the trial of the cause, they showed that he was seized of the premises in fee, by a deed dated August 21, 1795, from John C. The questions presented to the court for consideration in the present case, if not in themselves peculiarly difficult, are unpleasant to act upon, inasmuch as they involve the construction of some of the earliest legislation of the territorial and state authorities, and render it necessary to decide upon the validity of some of the acts of our courts in the infancy of the government.
