HARRIS, Judge.

Appellant was convicted of robbery and his punishment fixed at imprisonment in the penitentiary for a term of twenty-five (25) years. At arraignment, attended by counsel, he interposed a plea cf not guilty.

On January 27, 1972, David Briscoe, an officer with the Courtland Police Department, was on a patrol duty in his well-marked police car on Alabama Highway 20 at or near the intersection of Highway 29, in the city limits of Courtland in Lawrence County.
