Liel W. Short and Katie A. Short, Co-administrators of the estate of Merl Lee Short, deceased, their son, sued the Missouri-Kansas-Texas Railroad Company and the Missouri Pacific Railroad Company, corporations, for the death of Merl occasioned by a northbound Missouri-Kansas-Texas fast freight striking Merl’s westbound automobile when he attempted to cross the tracks of said defendants upon a switching movement of the Missouri Pacific clearing the crossing at Hickory street in the city of Nevada, Missouri,.at 2:20 a. m., May 16, 1954. Plaintiffs submitted their case…
