delivered a dissenting opinion.
I cannot concur with the views expressed in the majority opinion. While there is ample evidence to sup port the verdict of the jury, there is also evidence from which the jury was authorized to find for the plaintiff, and in my opinion, the instructions in the case, instead of giving a consistent and proper announcement of the law, are incorrect and some of them are fatally erroneous.
