MEMORANDUM AND ORDER

GLASSER, District Judge.

In this action, plaintiffs Elizabeth Pecere (“Pecere”) and Linda Prince (“Prince”) allege that defendant Empire Blue Cross & Blue Shield (“Empire”) has a specific policy of routinely denying treatments for pain alleviation and pain management in an arbitrary and capricious manner and without regard to medical necessity.
