delivered the opinion of the court.

This was a prosecution of the plaintiff in error, George Morgan, by the people, for an alleged violation of sections 1 and 2 of the act entitled “ Animals.” It was commenced on July 16, 1900, by one Canady making a sworn complaint to a justice of the peace in Vermilion county, in which it was in substance charged that plaintiff in error on July 15, 1900, willfully, unlawfully and maliciously permitted certain cows to ran at large upon the public highway of Vermilion county, Illinois, contrary to the statute.
