Appeal by Valentine A. Truszkowski from an order of the Supreme Court, made at the Erie Special Term and entered in the office of the clerk of the county of Erie on the 21st day of September, 1915, as resettled by a further order entered in said clerk’s office on the 22d day of September, 1915.

Kruse, P. J.:

Valentine A. Truszkowski, the appellant, and William Tenjost, respondent, were rival candidates for member of the Republican State Committee in the Sixth Assembly district of Erie county at the election held in the fall of 1911. According to the votes as canvassed by the board of elections, based upon *130the returns made by the inspectors of election of the several election districts, it appeared that Truszkowski had been elected.
