Riley, Judge:

In this action of trespass on the case to recover damagés for alleged personal injuries, instituted in the Court of Common Pleas of Kanawha County, the plaintiff, Frank Skaff, was awarded a judgment based upon a jury verdict in the amount of twenty-five hundred dollars against the defendants', Henry Dodd and The Automotive Parts Company, an Ohio corporation, to which judgment the Circuit Court of Kanawha Couhty refused a writ of error and supersedeas on the ground that the judgment of the court of common pleas was plainly right.
