This action was'brought by the plaintiff against the defendant in the district court of Fillmore county to obtain a ■divorce, upon the grounds of cruelty and failure to provide •a suitable maintenance. The cause was referred to a referee, who made a report in favor of the plaintiff. The report was confirmed and a decree of divorce rendered, with permanent alimony to the amount of $2,000, to be paid by installments. • The defendant appealed to this court.
