The parties were married May 16, 1923, at Utica, N. Y. December 3, 1924, a child, Doris Vivian Owens, was born. The marriage proved to be an unhappy one. After the daughter was born, defendant abandoned plaintiff and said child and went to Pennsylvania. He was indicted by a grand jury of Oneida county on a charge of abandonment and was brought to the city of Utica, arraigned in County Court and was released on $1,500 bail, upon promising to care for bis wife and child.
