On January 31, 1908, a petition in in-vpluntary bankruptcy, was'filed by certain unsecured creditors against W: C.. Carpenter in the District Court of the United States for the District of South Carolina. The petition charged that Carpenter, 'while insolvent, had permitted certain creditors to obtain a preference through judicial proceedings, namely, judgments, under which levies had been made-and his property advertised for sale.
