Our statute, section 2060, Revisal, provides in effect, “That the possession of or issuance to any person of a license to manufacture, sell, or rectify whiskey by the United States Government, in any county, city, or town where such manufacture, sale, etc., are prohibited by law, shall be prima facie evidence that the person having such license or to whom the same was issued is guilty of doing the act pei’mitted by such license in violation of the laws of the State,” etc. The occasion for the enactment of such a law and its application to a state of facts not…
