This case was before the court in 1879, and is reported *169in the 9th volume of the Reports, page 331. In that case the issues were fairly presented as to the matter in dispute, and it was held (page 337) that “ School District No. 6 has no interest whatever in the money in question.” The judgment of the district court in favor of District No. 6 was reversed and the cause was remanded. And the court on its own motion, directed that the money should be distributed to the several districts from which it had been raised on the basis of the assessment of 1872.
