OPINION

ANNE GARDNER, Justice.

I. Introduction

Appellee Stewart Le Richardson was charged by indictment with multiple counts of intoxication-related crimes arising out of the same episode. The indictment also alleged prior convictions as repeat-offender notices to enhance the punishment range. At a pretrial hearing, the trial court granted Appellee’s motion to quash the enhancement allegations, and the State appealed. After the case was submitted and argued, this court requested briefing from the parties on whether the trial court’s order constituted a dismissal of any portion of the indictment…
