OPINION
TIPTON, Judge.
The petitioner, William L. Church, appeals as of right from the Hamilton County Criminal Court’s dismissal of his petition for both a writ of habeas corpus and post-conviction relief. The petitioner contends the following:(1) the trial court erred (a) in holding that the post-conviction petition was time-barred and (b) in raising the issue of the statute of limitations on its own; and(2) the trial court erred in holding that it lacked habeas corpus jurisdiction because the petitioner is imprisoned in another state.
