Rumsey, J.:

The action was brought to foreclose a mortgage given by Martin Thatcher, the committee of the person and estate of Henry Barnard, a lunatic.

The committee, after his appointment as such, took Barnard to the State Lunatic-Asylum, where he remained until he was dis7 charged therefrom. At the time of his discharge, in the summer of 1877, there was due to the asylum for his maintenance while there $1,425, and on the 1st day of October, J 877, an action had been commenced against the committee to recover it.
