The material facts in this case are undisputed. On or about July 7,1933, Cauldwell-Wingate Construction Corporation, a corporation which had a contract for the construction of the Department of Health and Sanitation Building in the city of New York, entered into an agreement with the Interstate Scaffolding and Shoring Corporation to erect a steel sidewalk bridge around said building for $4,500, all of which sum the Cauldwell-Wingate Construction Corporation claimed was paid, except $636.20.
