GRAVES, Judge.

Appellant was convicted of the murder with malice of Eugene Eddings, and by the jury sentenced to serve twelve years in the penitentiary.

The facts show that on the night of the fatal difficulty appellant, his brother Otis Johnson and the deceased, among others, attended a dance at the residence of a Mr. Rodgers. That sometime during the dance appellant’s brother Otis and the deceased engaged in an argument, the details of which are not clearly shown by the testimony.
