Appellants Charles Naucke and John Duvall appeal the grant of summary judgment in favor of respondent Missouri Public Entity Risk Management Fund (MO-PERM). Naucke and Duvall had brought suit against MOPERM seeking to recover the punitive damage portions of judgments granted against a city employee covered by the Fund. MOPERM had voluntarily paid the compensatory damages and attorney fee portions of appellants’ judgments.
