Gardner, J.(a) The defendant was convicted in the Criminal Court of Fulton County for the offense of simple larceny in stealing a lady's white pocketbook. In due course the defendant made application for certiorari to the Superior Court of Fulton County. The application was granted, but on hearing, the certiorari was overruled and denied. Error is assigned on this judgment.
