HENDERSON, Judge.

Appellant was convicted of murder in the second degree, and his punishment assessed at twenty-five years in the penitentiary; and prosecutes this appeal.

This is the third apeal of this case, appellant having been tried twice before, convicted, and his case reversed. For a report of the facts on former trial see Moore v. State, 7 Texas Ct. Rep., 17; 44 Texas Crim. Rep., 526; 72 S. W. Rep., 595; and 8 Texas Ct. Rep., 116. The facts on this trial are substantially the same as on the former trials.
