MEMORANDUM OPINION

This action arises out of a dispute between the Debtor, Allegheny International, Inc. (hereinafter “AI”) and an environmental waste remediation company, Remcor, Inc. (hereinafter “Remcor”). Remcor and AI entered into contracts post-petition to remediate two sites in Newburgh Heights, Ohio contaminated with low-level radioactive waste (depleted uranium).
