At the trial, before a judge sitting without a jury, Charles Kalb, appellant, was found guilty upon an indictment charging assault and battery and aggravated assault and battery, in striking, with his automobile, one John Bee as he was walking across Biverside Drive in Fairmount Park, Philadelphia. The statement of questions involved relates solely to the sufficiency of the evidence to support the verdict.
