FLY, Associate Justice.

This is a suit against appellant and the city of San Antonio arising from the negligence of appellant in not placing signals of warning on a ditch dug by it on a street in the city of San Antonio. A trial by jury resulted in a verdict and judgment for appellee in the sum of $2500.

The evidence sustains a finding that appellee was seriously and permanently injured through the negligence of appellant. It was in evidence that the ditch into which appellee fell was dug by appellant under authority given it by the city of San Antonio, and it is contended in the first…
