ARCHBARD, District Judge.

This is an action for the death of Roy Siegel, which occurred on November 23, 1907, and was caused, as it is claimed, by the negligence of the defendant company. The plaintiff is the widow, and the action is brought in behalf of herself and her minor child, under the statutes of Pennsylvania, which allow of a recovery in the case of death caused by unlawful violence or negligence. The deceased was a brakeman in the employ of the defendant company, and his death occurred while he was assisting in that capacity in shifting an empty “gondola” car in the railroad yard at…
