This case was tried, non-jury, on June 28 and July 7, 1999. The Court makes the following findings of fact and conclusions of law.
FINDING OF FACTS
1.Defendant, Pedro Sellan, was employed by the Seafarer’s International Union as a chief steward aboard the Plaintiffs vessel, Sea-Land Expedition, on November 6, 1993. On that date, he was moving a heavy box of meat when he suddenly felt pain in his back. As a result of this injury, Pedro Sellan brought a claim against Plaintiff, Sea-Land Service, Inc.
