Appeal from a *1192judgment of Niagara County Court (Fricano, J.), entered January 9, 1997, convicting defendant after a jury trial of, inter alia, sodomy in the first degree (five counts).

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
