This is an appeal from the dismissal of a petition for a writ of habeas corpus and a motion to vacate judgment in the Clayton County Superior Court.

Larry Craig, appellant here, is presently incarcerated in the United States Penitentiary in Terre Haute, Indiana. Appellant’s habeas corpus petition was dismissed for lack of jurisdiction due to the fact that he was not restrained of his liberty in the county in which the petition was filed. Code Ann. § 50-127 (3); Neal v. State, 232 Ga. 96 (205 SE2d 284). The motion to vacate judgment was dismissed due to a failure to prosecute…
