OPINION

SCHROEDER, Judge.

This is an appeal from a conviction of lewd and lascivious acts, in violation of A. R.S. § 13-652. Appellant’s two co-defendants at the trial were charged with rape. All three crimes allegedly were committed with the same victim during the same evening. The jury returned a verdict of guilt against the appellant, but failed to convict or acquit the co-defendants, Williams and Smiley.
