Appeal from Baltimore county court. This was an action of assumpsit, brought by the appellant on the 17th April, 1834. The declaration was endorsed with an order to the clerk of the county court, to “docket this suit by consent, and enter the case referred according to the agreement in Carroll vs. Me Tavish and Catón, to Stevenson Archer and Richard B. Magruder, Esqr's, they having been selected according to the terms of that agreement.
