This matter came before the Court for the first phase of a bifurcated trial on Plaintiff City of Bangor’s (“City”) claims under both the Resource Conservation and Recovery Act (“RCRA”), 42 U.S.C. § 6972(a)(1)(B), and the Comprehensive Environmental Response, Compensation, and Liability Act (“CERCLA”), 42 U.S.C. § 9607. Notably, Defendant Citizens Communications Company (“Citizens”) has asserted counterclaims against the City under both CERCLA, 42 U.S.C. § 9613(f)(1), and RCRA, 42 U.S.C. § 6972(a)(1)(B).
