1Opinion of the CourtEggleston, J.
Douglas Griffith, while employed in a coal mine owned and operated by Raven Red Ash Coal Company, Inc., was killed by an explosion in the mine. His widow and dependent children filed before the Industrial Commission of Virginia a claim for compensation which, after a full hearing, was denied on the ground that the evidence failed to show that the deceased “was engaged in anything in furtherance of the interest of his employer at the time the explosion occurred”, and that hence the fatal accident “did not arise out of and in the course of the employment.” No appeal was taken from this finding…
