In the fiscal year 1952-1953 the Fellowship of Humanity, a nonprofit corporation organized under the laws of California, owned certain real property in Oakland. It claimed exemption from city and county property taxes on the ground that the property was used “solely and exclusively for religious worship” within the meaning of article XIII, section 1% of the state Constitution. Its claim for exemption was denied. After unsuccessfully pursuing its administrative remedies, the Fellowship paid the taxes and penalties under protest, filed its claim, and commenced this action to recover the amounts…
