STATEMENT OF THE CASE

The Evansville-Vanderburgh School Corporation (EVSC) brings this interlocutory appeal from the Gibson Cireuit Court's order denying EVSC's motion to dismiss Counts II and III of appeliee Mike Roberts' (Roberts) complaint seeking judicial relief from an alleged unfair labor practice. Roberts is president of the Evansville Teachers Association, the exclusive representative of the teachers employed by EVSC.

We reverse.
