FAY, Chief Justice.

On October 8, 1987, a jury convicted Eddie Dordain (Dordain) of assault with a dangerous weapon upon Charles Graves (Graves) and assault with intent to murder Geraldine Spears (Spears). The defendant appeals the conviction to this court, assigning as error the trial court’s instruction to the jury that assault with a dangerous weapon may be considered a lesser included offense to assault with intent to murder.
