Appeal from a judgment of the County Court of Sullivan County (LaBuda, J.), rendered February 6, 2012, which resentenced defendant following his conviction of the crime of arson in the second degree.

Defendant was convicted of arson in the second degree following a jury trial and, in 2000, he was sentenced as a second felony offender to a term of 25 years in prison. His conviction was subsequently affirmed on appeal (293 AD2d 822 [2002], lv denied 98 NY2d 674 [2002]).
