A statement of most of the material facts of this case, together with the substance of the pleadings, will be found in Braumiller et al. v. Burke, 173 S. W. 609. That publication, however, does not contain the opinion of this court on the motion for a rehearing, in which the facts are more fully stated. The motion to certify to the Supreme Court the questions involved was overruled in February, 1915.
