This is an action on the case by the plaintiff as administrator of H. W. Smith, against the defendant below, for the negligent killing of plaintiff’s intestate on February 20, 1901. The case was tried in the Circuit Court of Will County resulting in verdict of §2,000 in favor of the plaintiff. A motion for a new trial was made and overruled and the defendant excepted and brings the record here, assigning that the court erred in overruling a motion to direct a verdict for the defendant, and to the giving of instructions for appellee.
