This appeal is from .an order of the district court for the Sixty-First district, granting a temporary injunc-tion upon the application of appellee in a suit in said court brought by appellee against appellant.

The case made by the pleadings and evidence is in substance as follows: In June of 1914, the appellant, a lumber company engaged in the sale of lumber in the city of Houston, purchased a lumber yard situated near the tracks of defendant railway company in said city.
