By this action, the plaintiff, a resident taxpayer of Golden Valley county, seeks to recover from the defendant, one of the board of county commissioners of the county, the sum of $541.31, together with twenty-five per cent thereof additional, as damages, and costs incurred in the action. The action is expressly predicated on section 4821 of the Revised Codes of 1921, and was instituted by the plaintiff on behalf of himself, “other taxpayers” in the county, and the “county of Golden Valley, * * * a municipal corporation.” The complaint alleges that the defendant presented a claim against the…
