This is an action by Norris R. Cox against Robert Alexander, John Robertson, and G. W. Wallace, to recover *440on a promissory note alleged to have been executed by the defendants to one Thomas O’Day, and by the latter assigned to plaintiff. The answer, after denying the material allegations of the complaint, which is in the usual form, alleges that Robertson and Wallace entered into negotiations with G. Kutschan, S. Walker, and Dave Ogilvie for the purchase of 10,500 shares of mining stock, agreeing to pay therefor $3,150, to be evidenced by the defendants’…
