Jimmy Spencer (“plaintiff”) filed a complaint in the Chancery Court of Davidson County against Evelyn C. Robertson, Jr., Commissioner of the Tennessee Department of Mental Health and Mental Retardation (hereinafter “Department”)1 and the Department (collectively referred to as “defendants”) seeking a declaratory judgment on the grounds that his due process rights had been violated as a result of his termination as a civil service employee.
