The defendant was convicted of the crime of perjury and appeals to this court, claiming that the trial court erred in refusing to grant his motion for a mistrial for alleged misconduct on the part of the prosecuting attorney in his opening statement to the jury, and also assigning error on the part of the court in overruling his objections to certain testimony offered by-the prosecution.
