COVINGTON, Judge.

Commerce Bank of Kansas City, N.A. (Bank), appeals from an order entering summary judgment in favor of the Missouri Division of Finance (Division) in the Bank’s action for a declaratory judgment. The judgment is reversed.

The Division is an administrative agency charged with administration of the Missouri Consumer Finance Act, §§ 408.-100-.210, RSMo 1986. 1 The Bank is a national banking association organized under federal law.
