delivered the opinion of the court.
This is a suit in forcible detainer begun by John S. Crain, appellee, against James F. Burnett, appellant, before a justice of the peace and appealed to the County Court of Piatt county. In the trial in the County Court a jury was waived, and the court found the appellant guilty of unlawfully withholding the possession of the premises described in the complaint, and judgment was rendered in favor of appellee.
