*1290Appeal from a judgment of the Erie County Court (Michael L. D’Amico, J.), rendered November 6, 1987. The judgment convicted defendant, upon a jury verdict, of murder in the second degree, attempted murder in the second degree, assault in the first degree and criminal possession of a weapon in the second degree (two counts).

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
