OPINION ON APPELLANT’S MOTION FOR REHEARING

DOUGLAS, Judge.

This is an appeal from a conviction for resisting arrest. A jury assessed punishment at thirty days in jail and a five hundred dollar fine, probated.

This judgment was affirmed in a per curiam opinion dated March 17, 1976, and the question of the constitutionality of the statute discussed below was not considered because of the late filing of an appellate brief.
