This suit was brought by the German National Bank of Denver, Colo., the defendant in error, against, the Missouri, Kansas & Texas Trust Company and the National Burety Company, the plaintiffs in error, who are hereafter termed, respectively, ihe “Trust Company” and the “Surety Company,” to compel the defendants below to discharge the liability of the trust company on a certain bond which the trust company had executed on October 4, 1892, in favor of the German National Bank of Denver, hereafter termed the “Bank.” The bond was given to insure the bank, for the' period of…
